Terms and Conditions for DBS Training Courses

These Terms and Conditions ("Agreement") set out the terms that Participants agree to when booking any course with PHEMcare Ltd (trading as IEM Consultancy and LoggIT) or acting on behalf of DBS (David Burrows-Sutcliffe), collectively referred to as IEMC.

If these terms and conditions are accepted on behalf of an organisation or any other legal entity rather than an individual, "Participant" shall also refer to such an entity and its affiliates. By accepting these terms, the Participant confirms they have the authority to bind the entity and its affiliates to this Agreement.

If the Participant does not agree to these Terms and Conditions, they must not access or use any course materials or documentation provided by IEMC.

By accepting these Terms and Conditions, whether by signing a form (physically or digitally), ticking an acceptance box, or accessing course materials, the Participant agrees to be bound by this Agreement, forming a contractual arrangement between the Participant and IEMC.

 

1. Definitions

This Agreement refers to these terms and conditions that govern participation in training courses. The Participant is the individual or organisation engaging in this Agreement and/or attending the course. IEMC refers to the course provider, legally known as PHEMcare Ltd, registered at 7 Bell Yard, London.

 

2. Term

This Agreement comes into effect when a course is booked, the Participant accepts these terms, or the course content is accessed, whichever occurs first. The Agreement shall continue indefinitely unless terminated in writing by either IEMC or the Participant.

 

3. Provision of Training

IEMC will deliver the booked training in accordance with the stated syllabus and course description.

4. Course Booking

Open courses, which are available for individual booking, can be reserved online at www.iemc.co.uk. Submission of a booking form constitutes an offer to IEMC. Once the booking is received, IEMC will review the application and, if eligible, send an email confirming a provisional place. A confirmed place is allocated only after full payment is received in accordance with the payment terms outlined in Section 5.

Closed courses, which are tailored to organisations, must be arranged by contacting develop@iemc.co.uk and cannot be booked online. The same payment terms outlined in Section 5 apply to closed courses.

 

5. Payment Terms

Payment for courses can be made via credit or debit card, bank transfer, or purchase order, which is available only to public sector organisations.

For credit or debit card payments, bookings remain provisional until full payment is received. If payment is not made within seven days of invoice issuance, the booking will be cancelled. If payment details provided by the Participant are incorrect or rejected, IEMC is not responsible for any costs arising from the cancellation.

For public sector organisations, a purchase order secures the Participant’s place on the course. Payment must be made at least seven days prior to the course commencement date.

Late payments are subject to interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 and the EU Late Payment of Commercial Debts Regulations 2003. Interest is charged at four per cent per month above the Bank of England base rate for payments overdue by one day or more.

 

6. Participant Obligations

Participants must comply with these Terms and Conditions, including those related to intellectual property and copyright. They must also adhere to the joining instructions, which will be sent at least seven days before the course begins and complete any pre-course learning if required.

Participants must observe all health, safety, and security regulations applicable at the training venue. IEMC reserves the right to remove any Participant from a course if their behaviour is deemed inappropriate. In such cases, no refund or reimbursement will be provided.

 

7. Eligibility

All Participants must meet the minimum eligibility requirements. Participants must be at least 18 years of age and be employed or contracted by a Category 1 or Category 2 agency as defined under the Civil Contingencies Act 2004 or any subsequent amendments. Individuals with strong links to these agencies or who hold an appropriate level of security clearance may be considered on a case-by-case basis.

 

8. Cancellation Policy

Courses can be cancelled in writing up to 28 days before the scheduled start date. In such cases, a £50 administration fee will be deducted from the refund. Refunds will be processed within 28 days and issued via bank transfer to the original payer. Participants may choose to transfer their booking to another course at no additional cost.

For cancellations made between 28 and 7 days before the course start date, a 50% refund will be issued. Refunds will be processed within 28 days via bank transfer.

For cancellations made within seven days of the course start date, no refunds will be issued.

IEMC reserves the right to cancel a course due to insufficient enrolment and will provide a minimum of seven days' notice in such cases. If this occurs, the Participant may choose either a full refund or a credit towards another course hosted by IEMC.

If a course is cancelled due to circumstances beyond IEMC’s control, including but not limited to industrial action, war, terrorism, riot, disaster, or failure of telecommunications (a Force Majeure Event), the Participant will be issued a credit note valid for six months. IEMC is not responsible for any additional costs incurred as a result of course cancellations.

 

9. Substitutions

Participants may nominate a substitute to attend the course in their place, provided IEMC is given at least 48 hours' notice. The substitute must meet the eligibility criteria outlined in Section 7. If the substitute is not accepted, the cancellation terms set out in Section 8 will apply. No additional charges will be incurred for approved substitutions.

 

10. Limitation of Liability

IEMC does not accept responsibility for actions taken based on information received during the course. Any opinions expressed by instructors are their personal views and do not represent the official position of IEMC or any other organisation. Participants should seek professional advice before making any decisions based on course content.

11. Copyright and Intellectual Property

All course materials, including text, design, style and layout, are protected under the Copyright, Designs and Patents Act 1988 and EU Copyright Directives (2001/29/EC & 2019/790/EU).

Course materials may not be copied, shared, distributed, or modified without the prior written permission of IEMC. All rights remain the property of PHEMcare Ltd © 2025.

 

12. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of England and Wales. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the English courts.
